A judge says WLW's Eric Deters wasn't libeled on Twitter or Facebook
Deters, an attorney who’s leaving the evening shift at Cincinnati's WLW (700), filed suit two months ago against Kenton Commonwealth’s Attorney Rob Sanders for comments he posted online. Now the Northern Kentucky Enquirer says Kenton Circuit Court Judge Martin Sheehan says that Sanders' remarks (about a verdict obtained by Deters in a different case) were his constitutionally-protected opinions. The judge says “The state’s interest in protecting the free and open expression of opinions cannot be lost on Deters, an individual who, when not practicing law, hosts what can certainly be termed a highly opinionated radio talk show.” Sheehan quotes Rodney King and asks both sides to learn to get along. Deters says “I accept his decision and I made a New Year’s resolution – I’m going to ignore my enemies.” Sanders said he was just goofing with his comments, made in the context of Deters representing what the Enquirer says are “people who sue the police.” He says “I made the mistake of acknowledging Eric Deters’ existence. I won’t make the same mistake again.” The Cincinnati Board of Radio-Info.com is talking about Eric Deters in his other role, as a part-time talkshow host on WLW, here.
