“Discrimination simply has no place in broadcasting”, says FCC Chair Genachowski

From today's TRI Newsletter: But the FCC Chairman has a tricky act to juggle, because what the FCC really wants to do – but can’t – is regulate the behavior of ad agencies and buyers. This is really about the buyer, not the media outlet that’s taking the business. All the Commission can do (thanks to a previous Chairman) is ask broadcasters on the new Form 303-S to certify that their ad sales agreements don’t discriminate on the basis of race or ethnicity. And that all station sales contracts have a non-discrimination clause. The Chairman issues a rare “enforcement advisory” about it, to signal its importance. The Minority Media & Telecommunications Council commends the FCC for the advisory, and also for its designation of a senior member of the Media Bureau staff to be a compliance officer for the “Broadcast Advertising Non-Discrimination Rule.”
