FCC can pursue its indecency crusade all the way to the Supreme Court
Chairman Kevin Martin wanted the Bush Administration to appeal the FCC's appeals court loss on two Billboard Awards-show slips - and late Wednesday, the Solicitor General's office announced it will file a writ of "cert" and ask the high court to consider Bono's f-word variant on Fox TV. The 2nd Circuit of Appeals said the FCC failed to justify changing its decades-old rule about fleeting expletives. Meanwhile, Martin's in his hometown of Charlotte for this morning's NAB Radio Show Chairman's Breakfast, and he tells the Charlotte Observer's Mark Washburn that the indecency guidelines are sufficient: "We're down to a very few words", and he says "the Commission is very clear about looking at the context in those cases." Though some PBS managers would disagree, having clipped words out of this week's "War" series by Ken Burns.
