Magic 95.3 Lawton, Okla., offers apology—and cash—for alleged "misconduct"
Broadco of Texas' top 40 KMGZ-FM (Magic 95.3) Lawton, Okla., has
finalized a settlement with the Premier Basketball League regarding
“unfounded and defamatory claims of alleged misconduct.” The original
April 18, 2011 accusation stems from KMGZ’s live broadcast of the final
PBL championship series game between the Lawton Fort Sill Cavalry and
the Rochester Razorsharks in Lawton. Cavalry employee Chris Needham,
announcing play-by-play commentary, made “various statements regarding
alleged misconduct on the part of officials and the PBL", according to
the PBL.
Magic President/GM Chuck Morgan wrote in an apology letter, saying that the station regrets the announcer's statements, and that none “reflect the views or opinions of this station, nor those of any affiliated business enterprise.” But atonement wasn’t enough for PBL: The settlement also includes an undisclosed settlement by KMGZ to the league. KMGZ’s letter, meanwhile, must remain on the station’s website for one year, as well as the PBL and Rochester RazorSharks sites, further acknowledging that there is no evidence supporting Needham’s “defamatory claims,” and making clear that he was an employee of the Lawton Fort Sill Calvary and not the station itself.
